MONTHLY BOARD OF SUPERVISORS MEETING

January 12, 2017
    

Thursday, January 12, 2017                                       7:00 p.m.                                             Town Hall
The Board of Supervisor’s meeting was called to order at 7:13 p.m.  

Officials present:  Chairman Dan Knutzen, Supervisor 1 Dan Rettler, Supervisor 2 Tom Neubert, Treasurer Jeri Ohman (left meeting at 8:04 p.m.), and Clerk Karen Herman.
Residents present:  Mike Garvey (left meeting at 7:56 p.m.); and Darrin Stingle was present at 7:19 p.m. (left meeting at 8:26 p.m.).
Sheriff’s Department:  No one present.

The agenda was posted according to the open meeting law on January 9, 2017.
 
MOTION:  Rettler/Neubert to approve a correction to the 11/14/2016 Town Board meeting minutes approving the 10/10/2016 Town Board meeting minutes instead of “audit hearing minutes”.  All said aye.  Motion carried.  

MOTION:  Neubert/Rettler to dispense the reading and accept the 12/15/2016 monthly Town Board Meeting minutes All said aye.  Motion carried.   

Building Permits:
None Reported

 

a.)  Sheriff Department– No one present.

b.)  Outagamie County Drainage Board Petition to have Town of Black Creek Land Annexed to Duck Creek
       Drainage District – The Town of Black Creek was not notified of this upcoming change.  Garvey notified            
       the clerk of the letter being mailed to landowners effected with the annexation.  The Drainage Board
       has been notified to put the Town of Black Creek on their mailing list.  Garvey is requesting that someone
       from the Town be present for the meeting on Wed., 1/8/2017 at the Town of Osborn.  Garvey expressed
       his concern regarding Bill 653 that it will override so no approval will be needed for future annexation.

c.)  Campground Located at W4096 Kropp Rd, Tim Manka PropertyAttorney has sent out the cease and
       desist letter.  Any questions should be directed to the attorney.
       Returned County Invoice Unpaid for Kropp Rd Campground AddressingMOTION:  Knutzen/Neubert
       pay $15 to County for Addressing.  All said aye.  Motion carried.  It has been determined that the Board
       issued the addressing request to the county.  Check will be mailed tonight.

d.)  Year End Budget Resolution #14-2016 
      A resolution to the 2016 Budget for the Town of Black Creek, adopted by a two-thirds majority vote of
      the entire membership of the Town Board.

      BE IT RESOLVED by the TOWN BOARD OF THE TOWN OF BLACK CREEK as follows:

      Beginning Balance in the following accounts:

      Checking FCCUaccount = $741.84

      Money Market FCCUaccount = $802,644.72

            The sum of $741.84 balance in the Checking FCCU account be

            transferred to the Road Maintenance FCCU reserveaccount.

            The sum of $802,644.72 balance in the General Money Market FCCU
                           account be transferred in the Road Maintenance FCCU reserveaccount.

            The new balance in the above accounts will be:

$0                                 Checking FCCU account.
$0                                 General Money Market FCCU account.
$803,386.56      Road Maintenance FCCU Reserve account.
Roll call vote:  Rettler-Yes; Neubert-Yes, Knutzen-Yes; 3 Yes/0 No; Approved      

          And #15-2016–Not needed.

e.)   Budget Resolution #01-2017
        A resolution to the 2017 Budget for the Town of Black Creek, adopted by a two-thirds majority vote of

        the entire membership of the Town Board.  BE IT RESOLVED by the TOWN BOARD OF THE TOWN OF
        BLACK CREEK as follows:

           The sum of$741.84 be transferred from the Road Maintenance FCCU
                        reserve account and put into the Checking FCCU account to get in
                        balance with the Treasurer’s checking account year end balances.            

                         The sum of   $768,098.22 (December 2016 Tax Collection) be

            transferred from the Road Maintenance FCCU Reserve account and put
            into the General Money Market FCCU account.

            The new balance in the Road Maintenance FCCU Reserve account will be

             $34,546.50.

The new balance in the Checking FCCU account will be

             $741.84.

The new balance in the Money Market FCCU account will be

             $768,098.22.
                        Roll call vote:  Rettler-Yes; Neubert-Yes, Knutzen-Yes; 3 Yes/0 No; Approved

 

            and #02-2017
            A resolution to the 2017 Budget for the Town of Black Creek, adopted by a two-thirds majority vote of

             the entire membership of the            Town Board.  BE IT RESOLVED by the TOWN BOARD OF THE TOWN OF
             BLACK CREEK as follows:

MONEY MARKET ACCOUNT

The sum of $300.00 from the FCCU Money Market Account betransferred to the Park and Recreation Savingsaccount because the “New Home – Park and Recreation Fee” was paid for by Resident Joey Tomazevic.

Total in the Park in Recreation Savings account $12,154.10.
Roll call vote:  Rettler-Yes; Neubert-Yes, Knutzen-Yes; 3 Yes/0 No; Approved

f.)  Treasurer’s Report with Receipts, Disbursements, Checking, and Money Market Accounts for Totals from
      the Previous Month
 

g)   Clerk Presents Bills and Transfers Money to Pay Bills–        
       MOTION:  Neubert/Rettler to accept the Treasurer’s Report, approve and pay the bills, and to transfer
       $656,100.00 to pay the bills.  All said aye.  Motion carried.
       Transfer slip was signed.

Dog Tags—Treasurer was unaware that a Kennel license is needed when a resident purchases 12 dog tags or more.  Town owed County an extra $21.00 when final dog licensing fees were submitted to the County.  Treasurer paid County the extra $21.00 from her personal money and will be reimbursed for the $21.00 on her March payroll sheets.  She will not receive wages for dog tag licensing.

h.)  Dennis VandeWalle parcel #010-0306-00 – No one Living in Home, Requesting that Garbage be Taken
       Off Tax BillLetter is to be sent to VandeWalle stating that we cannot refund the 2017 payment
       because it has been figured into the contract payment with Harter’s Fox Valley Disposal.  The change
       will be made for the 2017 tax year.  MOTION:  Neubert/Rettler to approve the above action taken. 
       All said aye.  Motion carried.

 i.)  Town Hall –RJM Construction Pavilion Plans/Storage ShedTabled until the next Town Board meeting.

Quote from Ralph Volkman with doing a $195.00 maintenance to convert charcoal filter into air recharge birm filter.  Rettler will let Volkman know to go ahead.

Knutzen approved and signed the Statement of Values (SOV) for the town hall and fire department building and content.  No updates were needed.  Clerk with approve the SOV online. 

 j.)  Roads– Brian Gruendeman will be trimming brush.  

      Roads and town hall parking lot are very icy!  Discussion took place whether to salt the town hall parking
      lot.  Hoping that the sun will melt the ice in the next few days.     

 k.) Planning Commission – January 26, 2016 Planning Commission Meeting 6:00 p.m.  
      --Creation of Base Farm Tract Map – This will be discussed at the next Planning Commission meeting.

     --Official Zoning Map needed according to approved Ordinance #01-2015 – Tabled until the next board
        meeting. 

     --Comprehensive Plan Yearly Implementation of Chapter 12 in 2017– This will be discussed at the next
        Planning Commission meeting.
     --Nathan Riehl – Purchasing 20 acres of Land Locked Land on Ott Rd for New Home, Requesting
        Variance/Approval
– Nathan will be attending the next Planning Commission meeting.
     --Zoning and Planning Consultant – Tabled until the next board meeting. 

Yearly 2016 Zoning Report due to Department of Agriculture, Trade and Consumer Protection (DATCP) – Discussion took place.  The clerk will notify DATCP that no rezones took place for 2016.

Knutzen will update the road and boarder changes and notify the Census.

Agenda Items for Upcoming Planning Commission meeting as of Today:  Nathan Riehl—Build Home on Land Locked Land; CSM’s for CS Rental and Walter Hess; New Zoning/Planning Consultant; Discuss Base Farm Track Map timeline for completion; Doersch on Ballard Rd selling property (Daniel Doersch & Donna Lubiniski) Parcel #010-0246-00.

Darrin Stingle was present to discussed putting 8” tile in ditch, approximately 300 ft on State Rd near South of Wick Rd on State Rd.  Ditch is level with the fielded.  Put on next month’s agenda.  Stingle will contact Lynsmeyer who has the abutting property to the right of way.      

 l.)  Permits Issued/Approvals/Violations (Building & Misc.)
       Jenny Court -- Driveway permit
MOTION:  Rettler/Neubert to approve Jenny Court’s driveway permit.
       All said aye.  Motion carried.

Chairman presented the board with 2 We Energies Boring Beneath the Road Permits:

--We Energies – Bore across State Rd by Hwy 54 & before Genske Rd.  (Road monument located there) 

WR3956588  MOTION:  Neubert/Rettler approve boring beneath the road.  All said aye.  Motion carried.

--We Energies – On Stingle Rd, between Hwy 47 and State Rd, Electrical cable replacement. 

WR3973858 MOTION:  Neubert/Rettler to approve the Electrical Cable Replacement.  All said aye.  Motion carried.  Clerk will bill We Energies for the 2 permits.

m.)  FIRE/AMBULANCE – PAST DUE FIRE/RESCUE RUNS –
        Chelsey Keller $797.50; Stephanie Manka $200.00; Peter Keberlein $200.00; Jamie Nerious $200.00;
        Fisk $200.00; Johnson $200.00; Richley (3) $606.00, $436.00, $556.00
        New Ambulance Runs – Colwitz $606.50; Kirmsee $200.00; McGlinn $200.00
 
        Town Ordinanceneeded for Fire Dept. to Bill Insurance Companies for Runs
          We have received no updates from our town attorney.  Knutzen will be checking into the status of the
         3 Richley runs.

n.)  Ryan Rohan – Hwy 54 Recycling Compliance ResultsNo official updates.

o.)   2/21/2017 February Primary (if needed) – Election Workers/Training/ Public TestClerk found out today
        that there will be a February Primary.  MOTION:  Knutzen/Neubert for the Clerk to set up the February
        election workers, training, and public test.  All said aye.  Motion carried.
        The Clerk will be purchasing a Dymo printer which is recommended for WisVote when doing absentee
        ballot lables.

p.)   Open Records Request for the November 8, 2016 Election DocumentsThe request from Wasserman has
        been withdrawn.

q.)   Backup Internet Emails Quote/New Internet Service --
        Discussion took place.  CenturyLink has installed more fiber optic lines within the town.  Tabled until the
        next board meeting.

r.)  Renew Building Inspector Contract – 3 Year Term Ending 4/8/2017
      The clerk will contact Paul Hermes to determine if any pricing revisions need to be made.  The town is fine
      with the pricing.

Reminder:  2/16/2017 is the effective date for the new Driveway & Right of Way Ordinance (posted in the 1/16/2017 newspaper).

This will be reviewed at the next Planning Commission meeting.

      Disposal.

Clerk will be recycling the old state statute books.
