MONTHLY BOARD OF SUPERVISORS MEETING

May 8, 2017
    

Monday, May 8, 2017                                              7:00 p.m.                                                    Town Hall

The Board of Supervisor’s meeting was called to order at 7:00 p.m.  

Present:  Chairman Dan Knutzen, Supervisor 1 Dan Rettler, and Supervisor 2 Tom Neubert; Treasurer Jeri Ohman (left meeting at 7:42 p.m.), and Clerk Karen Herman.
Residents present:  Tom & Nona Kranzusch and Kyle Kranzusch (all left the meeting at 7:34 p.m.); Ken & Denise Wagner (left the meeting at 7:28 p.m.); Russ Raddatz (left the meeting at 7:38 p.m.); and Mike & Brenda Garvey (Brenda arrived at 7:09 p.m., left at 7:45 p.m.).

The agenda was posted according to the open meeting law on May 4, 2017.
 
MOTION:  Rettler/Neubert to dispense the reading and accept the minutes from the April 10, 2017 Town Board monthly meeting.  All said aye.  Motion carried.   

Building Permits:
#2 Mike Brandt – Garage with electric
#3 Lee Lemke – Garage with electric
#5 Tim Holtz – Shed with electric
#6 Gary & Sandy Van Camp – New House with electric and plumbing

a.)  Sheriff Department– No one present.      

b.)  Ken & Denise Wagner Drainage and Pond Issues– Ken and Denise Wagner were present to discuss the
       drainage and pond issues.  Ken wanted to know if there are any restrictions with a 40ft windmill and
       aerator being placed on his property.  The board informed him that there are none.   Knutzen reviewed
        Ken’s maps (none of Ken’s maps were filed with the Clerk).  The Wagner’s received a letter from the
        Outagamie County Zoning Dept. stating that no application was received for a permit to conduct a
        land disturbing activity, the Wagner’s will need to resolve this violation with the County. 
        Tomorrow morning Knutzen will be viewing this situation with the Wagner’s on site.  Knutzen will be
        referring this matter to the County Drainage & Surveyor.  Looks like a large drainage overload.

c.)  Annual Meeting – Wednesday, April 19, 2017 at 7:00 p.m./Guest Speakers
       All went well.  Nice lunch!  Take off agenda.

d.)  Constable DutiesWith the recent local elections, the Wisconsin Town’s Association is creating an
       ordinance in regards to the Town Constable duties.  As of today, we have not received a copy of this
       ordinance.  Tabled until the next board meeting.

e.)  Budget Resolution #03-2017Not needed for this meeting.

f.)   Review the Treasurer’s Report with Receipts, Disbursements, Checking, and Money Market Accounts for
      Totals from the Previous Month.  Clerk Presents Bills and Transfers Money to Pay Bills

      MOTION:  Neubert/Rettler to approve the treasurer’s report, accept and pay the bills, and transfer
      $20,000 to pay the bills.  All said aye.  Motion carried.

Clerk purchased the new WTA Town Officials handbook and the town board will be holding off with purchasing additional copies at this time.

g)   Approve the Public Notice – Description of Town Organizations, Legal Custodians of Town Roads, and to
       Establish Times and Places for Access, Inspections and Obtaining of Information as to Town Records
      
MOTION:  Rettler/Neubert to approve the public notice – Description of Town Organizations, Legal

.  All said aye.  Motion carried.

h.)  Tire Recycling and Scrap Metal Collection Set for Saturday, April 15, 2017The tires collected was ¾ of a
      dumpster. 

Put scrap yard waste collection request on next month’s agenda.

 i.)  Town Hall –RJM Construction Pavilion Plans/Storage ShedTabled until the next board meeting.
       Town Septic System Maintenance (POWTS) ReportTabled until the next board meeting. 
       Backup Internet Emails Quote Received no quote. 

j.)   Roads – Take Down Weight Limit Signs on Town Roads– Around April 15th the weight limit signs were taken
      off the town roads.  The Ballard Road Barricade was taken down the same week as the town weight limit
      signs.

Bridge Inspection Authorization – MOTION:  Neubert/Rettler to approve an authorization inspection through the Outagamie County Hwy Department.  All said aye.  Motion carried.  Clerk will forward this document to the County.

       Town Signage Stolen and Vandalized on Roads – Loss Reporting Insurance – Bill for replacement
       signage/supplies has been received but we haven’t received the order.  Check will not be mailed until
       the signs/supplies have been received.

        Road Bids– Clerk provided the board with documentation explaining when road work needs to be
        published in the paper versus publication and bidding.

Twelve Corners Rd (North of Ott Rd) was repaired because the road was falling in by bands around culvert and the culvert ends were replaced.             

 k.)  Planning Commission – Next Meeting:  Tuesday, May 23, 2017 6:00 p.m.
       Creation of Base Farm Track Map
– The Planning Commission is currently working on the Base Farm Track
       Map.
        Official Zoning Map Needed According to Approved Ordinance #01-2015The process of this map
       creation was discussed with Dave Johnson.
        Comprehensive Plan Yearly Implementation of Chapter 12 in 2017 – This is an ongoing process.
        Zoning and Planning Consultant
        Dave Johnson from the Outagamie County Planning Department attended our last Planning
        Commission meeting which was very informative.

 l.)  Permits Issued/Approvals/Violations(Building & Misc.)
      Wisconsin Technology Networking—Working in the Road Right of Way Permit Extension, Hample Road,
      100 Ft Tower Installation
Tower has been removed or cut off on Hample Rd.  The new tower installation
      on the back slope of the ditch has not been completed.  Russ Raddatz expressed that the tower is
      located where he would want his future driveway to his future new house located.  He would like the
      tower moved down the road.  Knutzen explained that engineers placed that tower in a necessary
      location.

Payment from Ann Young $200 was received.  Thank you for the payment.
        Pay BC Rescue Tonight for the Uncollected Ambulance Runs for the Following:  Saliete Biagini $656.25; 
        Karen Bero $835.50; Mitchel Gibbon $596.50
Clerk will forward the runs to the attorney.  Knutzen will be
        talking with the town’s attorney about these 3 new runs and reviewing all uncollected runs.

        Town Ordinanceneeded for Fire Dept. to Bill Insurance Companies for RunsTabled until the next board
        meeting.               

Rettler mentioned that a statewide burning ban is on.

n.)  Ryan Rohan – Hwy 54 Recycling Compliance ResultsTabled until the next board meeting.

o.)   Elections:  New Election Equipment Procurement for 2018 with Outagamie County – Consideration of
       Approval
Clerk reviewed the process with the Town Board.  Waiting to receive the official documents
       to consider for approval.       

p.)   Drainage District Meeting, Annexation MapsKnutzen attended the Drainage District Meeting.  He
        reviewed the new annexation map.  The County will contact landowners with the upcoming
       annexation changes.

q.)  Open Book – June 28, 2017 from 4:00 p.m. – 6:00 p.m.Tabled until the next board meeting.
      Board of Review – June 28, 2017 from 6:00 p.m. – 8:00 p.m.The clerk has contacted all Board of Review
      Alternates and has given all members and alternates a link to the 2017 Guide for Board of Review (BOR)
      Members.  Upon request, the Clerk will make printed copies of the booklet.  The Clerk expressed that
      some alternates wish to be notified if he/she is not needed as an alternate for the BOR. 
      The Clerk will not know if an alternate is needed until the BOR has completed.  Alternates may be
      needed due to an unexpected illness and absence too.

r.)  County Preliminary Consultation Checklist Reports and/or Certified Survey Map (CSM)
     Kirk Joachim 010019300

    The following is the Planning Commission Motion from the April 26, 2017 Planning Commission Meeting:
               MOTION:  Lemke/West recommend the Town Board to approve the Lot 1 and Lot 2 split for the Joachim CSM.
               All said aye.  Motion carried.    

     MOTION:  Rettler/Neubert to approve Kirk Joachim’s Certified Survey Map.  All said aye.  Motion carried.
      Property is zoned exclusive agriculture.  The Clerk will mail the approved CSM and permit back to the
      surveyor.

     Lang Landscaping 010008400, 010008402, and 010008800– Tom & Nona Kranzusch and Kyle Kranzusch
     were present for this meeting.
     The following is the Planning Commission Motion from the April 26, 2017 Planning Commission Meeting:
            MOTION:  Garvey/Lemke to recommend the Town Board approve the CSM for Lang.  All said aye.
            Motion carried

      MOTION:  Rettler/Neubert to approve the land divisions for Lang Landscaping.  All said aye.  Motion
      carried.   Changed sizing of Lot 1, 2, and 3.  Kranzusch’s took the approved (signed) original CSM and
      permit with them.

s.)  Garbage/Recycling Contract Ending 12/31/2017 with Harter’s Fox Valley Disposal– Knutzen will be
      contacting Harter’s for their proposal to review at the next month’s meeting.  Clerk will contact Chris
      Miller from the Outagamie Solid Waste Department to let her know that the Town of Black Creek will be
      going out for bid with the new contract.

t.)  2017-2018 Licensing—Background Checks and Newspaper Notices for Romy’s Nitingale LLC and Black
     Creek Sportsman’s Club, Inc.
– Clerk has notified the newspaper with  a Notice of Applications for Liquor
     and/or Beer Licenses for the following: 
     --Keith M. Romenesko, Agent for Romy’s Nitingale LLC requesting a “Class B” Liquor and Class “B” Beer
       License.
     --Kyle A. Abel, Treasurer/Agent for Black Creek Sportsman’s Club, Inc. requesting a Class “B” Beer License.

u.)  Linda DeWall—Grass Died due to Garbage Truck Hydraulic Oil Spill – Knutzen will talk to Andy Gayhart
      with Harter’s Fox Valley Disposal, regarding this issue.


Correspondence taken care of.

Payment for a new construction addressing number and post shows $75 plus S&H on our Fee Schedule.  Neubert said to charge just $75.

Rettler informed the board that Joey Tomazevic has paid the new construction signage fee.  Clerk will verify this and bill Joey $75 if he hasn’t paid.

Outagamie County would like to email billing in the future.  The board wants to continue to receive the billing in the mail (USPS).
 

Total Bills for May 2017:  Fox Communities Credit Union = $20,037.48
