MONTHLY BOARD OF SUPERVISORS MEETING
Regularly scheduled for Monday, November 9, 2015 was
rescheduled to tonight, Thursday, November 12, 2015   

Thursday, November 12, 2015                                      7:00 p.m.                                            Town Hall

The Board of Supervisor’s meeting was called to order at 7:06 p.m.

Officials present:  Chairman Dan Knutzen, 1stSupervisor Dan Rettler, 2ndSupervisor Tom Neubert, Treasurer
Jeri Ohman (left at 7:55 p.m.), and Clerk Karen Herman.  Deputy Sheriff Southard was present to discuss town issues and left at 7:23 p.m.  Dave Daniels from the Town of Cicero attended our meeting at 7:30 p.m. while he was waiting for the Farm Bureau meeting to begin at the Town Hall and left at 7:40 p.m.

The agenda was posted according to the open meeting law on November 7, 2015. 

MOTION:  Rettler/Neubert to approve the Audit Hearing minutes from September 16, 2015.  All said aye.  Motion carried. 

MOTION:  Neubert/Rettler to approve the Working on the 2016 Budget and Fee Schedule meeting minutes from October 21, 2015.  All said aye.  Motion carried.  
   
MOTION:  Neubert/Rettler to approve the monthly Town Board meeting minutes from October 12, 2015.  All said aye.  Motion carried.  

MOTION:  Neubert/Rettler to approve the 2015 Board of Review Minutes from October 29, 2015.  All said aye.  Motion carried.  

Building Permits:         
#13  Tom Ashman – Shed with Electric                               

a.)  Sheriff Department– (The Sheriff’s Department Staff Sergeant was contacted regarding to tonight’s
       meeting date change).  Thank you Deputy Sheriff Southard for attending our meeting tonight.  Burglaries
       were discussed on County Rd F and Town of Seymour.  People are leaving their house and vehicle doors
       unlocked.  The thefts are happening when people are home too.  Hunting violations will be occurring
       now. 

b.) County Preliminary Reports or Certified Survey Map (CSM) approvals:  Peotter CSM 010-0001-00 and 010-
       0001-01; Volkman CSM 010-0784-00
       –Peotter CSM was reviewed and approved by the Planning Commission – MOTION:  Neubert/Retter to
       approve the CSM and CSM Permit for Anne Peotter.  All said aye.  Motion carried.  Clerk will contact
       surveyor to pick up the approved CSM and Permit.
       –Volkman CSM—Clerk updated the Town Board that we are waiting for the surveyor to submit the Town
       CSM Permit and to receive copies of the CSM for the Planning Commission to review.

C.)  Treasurer’s Report on receipts, disbursements, checking, and money market accounts for totals from the
       previous month– The reports were reviewed. 

       Treasurer will be buying stamps, address labels, envelopes, and a new tax bill address stamper for
       mailing and collecting taxes. 

d.)  Budget Resolution 12-2015

                   RESERVE ACCOUNT

The sum of $59,129.69 from the Reserve Road Maintenance be transferred to the Road Maintenance budgeted account.

e.)  Clerk Presents Bills and Transfers Money to Pay BillsMOTION:  Rettler/Neubert to approve the
       Treasurer’s Report, approve the bills, and to transfer $30,300 to pay the bills.  All said aye.  Motion carried

f.)   Mike & Cindy Koller Division of Land to Build Home 010-029302– Clerk gave the Chairman Koller’s phone
      number for him to contact. 

g.)  Approve Memo of Understanding Agreement (MOU) with Outagamie County as our Provider for
       Elections–We should be receiving the agreement to be approved at the December Town Board
       meeting. 

h.)  Approve Election Inspectors for 2016-2017 Term– List will be approved at the December Town Board
      meeting.                 
 
i.)  Town Hall –Board Room Cabinets– Tabled until the next board meeting.

j.)  Roads–
      Ballard/Culbertson Rd Culvert – Install New Culvert–Brian Gruendemann is trying to fit the repairs in with
      his schedule.
      Culvert Fallen in – Schimmelpfenning Rd Off of County Rd PP by First Home– A locate of power was done.
      Brian Gruendemann is trying to fit the repairs in with his schedule.
      Kropp Rd – Gravel on the Shoulder by the Road Curves– Brian Gruendemann will be taking care of.
      W4820 Krueger Rd – Trees Trimmed in Right of Way– Knutzen will be contacting Timber Creek to take
      care of.
      Pot Holes on Town Roads– A new load of patch has been delivered to Brian Gruendemann’s home by
      Darrin stingle.
      Purchasing Town Road Name Signs and Posts– The other half of the Town’s road name signs will be
      purchased next year.  Take off agenda.

Using 2 posts for Schimmelpfenning Rd name sign when installing.
Neubert will be installing more new road name signs tomorrow. 

      Wolf Rd by County Rd PP—Grading Gravel– On the dead end part of the road, East side of County Road
      PP, there are pot holes.  The board will be looking into this situation. 

Knutzen will be contacting Scott Marcks Trucking to do snowplowing this year. 

k.)  Planning Commission – Creation of Base Farm Tract Map– Tabled until the next board meeting.
      Official Zoning Map needed according to approved Ordinance #01-2015– Tabled until the next board
      meeting.
      Future Comprehensive Plan Meetings
      Knutzen has contacted Jeff Sanders with Community Planning and Consulting to have him rewrite the
      Subdivision Ordinance so the secondary items are suggestions.  Possible approval of our Comprehensive
      Plan may occur early December.  Clerk is to wait to hear back from Knutzen before updating the
      Planning Commission and Village of Black Creek with further meeting dates.
 

 l.)  Permits Issued/Approvals/Violations (Building & Misc.)– 
      Shed Building Permit at N5800 County Rd PP (010-049701) looks like a Cabin– Tabled until the next board
      meeting. 

       Building Permit #13 issued to Tom Ashman – Shed with Electric.  Clerk will email the permit to
       our Building Inspector. 

m.)  FIRE/AMBULANCE – PAST DUE FIRE/RESCUE RUNS – Jason Vanderwegen $296.00; Cody Plaster $714.25;
        Chelsey Keller $797.50; Ann Marks $749.25– Received $25 payment for Vanderwegen from Attorney.

       The Town’s Attorney collection process was reviewed for the other outstanding runs.
           
       Town Ordinanceneeded for Fire Dept. to Bill Insurance Companies for Runs– Not discussed with the
       Village of Black Creek yet.  Tabled until the next board meeting.

       New Ambulance Runs:  David VerVoort $200.00; Stephanie Manka $200.00:  Knutzen contact Kathy
       Pasch with BC Rescue and 3 notices were sent for these runs.  Attorney is waiting for a response from the
       Town regarding the VerVoort collection.  Services were received with no transport.  Knutzen will be
       contacting VerVoort and then, intern, contact the Clerk to inform the collection status to our Attorney.  

n.)   Ryan Rohan – Hwy 54 Recycling Compliance Results–Knutzen has contacted our Building Inspector
        and will now be contacting our Town Attorney. 

o.)   Approve Harter’s Garbage & Recycling Costs for 2016MOTION:  Neubert/Rettler to approve $2.65 for
        recycling cost per month/household and $9.74 for garbage costs per month/household with Harter’s for
        2016.  All said aye.  Motion carried.

The Clerk updated the Board that Outagamie Counties recycling rates with Inland fluctuate according to the diesel fuel costs.  When the fuel costs go down, their set price will go down.  Our price is set and if the fuel prices decrease we still pay the same set price with no surcharge for the diesel fuel costs.  Since the Town has their own recycling contract, we will be reimbursed for the monthly recycling cost according to Inlands rates. 

Outagamie County Recycling and Solid Waste will be contacting us, in the future, to discuss the benefits of carts.

        Approve Garbage/Fuel Surcharge costs to be Assessed as Special Charges –
        MOTION:  Rettler/Neubert to assess as a special charge on the tax bill $117.06 per household which
        includes an 18 cents fuel surcharge.  All said aye.  Motion carried.

p.)  Resolution 13-2015 to Approve the 2016 Town of Black Creek Fee Schedule
        Roll call vote to approve the 2016 Town of Black Creek Fee Schedule effective January 1, 2016:
        Rettler=Yes; Neubert=Yes; and Knutzen=Yes
        3=Yes; 0=No
        Passed   

On next month’s agenda:  Approve Updated Building Inspector Contract Effective 1/1/2016. 

q.)   2015 Pavement Ratings are due to WisDOT by 12/15/2015– Pavement ratings have been completed by
        the County.  Knutzen will be contacting for the paperwork. 

 r.)   Budget Hearing 11/11/2015 at 7:00 p.m.– The Budget Hearing took place last night. 

 s.)   Research New Property Insurance for BC Fire and Town Hall—Looking into in January.  Put on January’s
        agenda.

 t.)   Resolution to approve the 2014, payable 2015 unused net new construction $1,461.00 from last year and
        include it with the payable 2016 levy— Resolution #14-2015 was approved at last night’s meeting of the
        electors.  The levy for the Town of Black Creek is $206,567.
       
u)  Adopt the 2016 BudgetMOTION:  Rettler/Neubert to approve the 2016 Budget.  All said aye.  Motion
      carried.  

v)  Appoint Replacement Board of Appeals Member
     MOTION:  Knutzen/Neubert to approve to Jeff McNichols for a 1-year term as a Board of Appeals
     Member.  All said aye.  Motion carried.

Chairman Dan Knutzen will not be able to attend the Monday, December 14, 2015 Town Board Meeting.  We plan to still have the meeting on Monday, December 14, 2015. 

Correspondence taken care of. 

Total bills for November:  Fox Communities Credit Union = $30,239.09
